Medical records are documents of tremendous social importance. They have been the subject of much medical and sociological research, in particular regarding validity, accessibility and readability. This paper uses Conversation Analysis to add an aspect to the understanding of medical records that has been missing so far, namely how medical records are produced as interactional accomplishments; specifically, how hospital staff members during meetings conversationally negotiate and reach conclusions, treatment recommendations, and other types of consequential decisions. The process involves four steps: (...) assessing patients, interpreting implications, drawing conclusions, and dictating conclusions on tape. The key finding is that participants throughout the process orient towards a need for consensus, whilst at the same time acknowledging the doctors’ interactional leading roles. This insight can enhance our understanding of medical records in hospital settings as constructed and negotiated realities. (shrink)

Patients sometimes visit their general practitioners with more than one concern. This article investigates when and how patients initiate presentations of such additional concerns. The study is conversation analytic in its approach and scope. It is based upon video-recordings of naturally occurring general practice consultations in Denmark. Data suggest that Danish patients relatively frequently initiate presentations of additional concerns and defer such initiations until moments when the parties would otherwise engage in closing down the consultations. Additional concerns are introduced in (...) response to the doctor’s possible pre-closing remarks. The parties, thereafter, employ a set of transitional elements: confirmation, preliminary announcement and ratification. This transition enables the parties to recycle the activities of the visit, to discuss and examine yet another concern. Thus, additional concerns are not presented completely unexpectedly or randomly as commonsense understanding sometimes has it; they are introduced at orderly moments and by means of recognizable methods. The article uses the 2010 political success of the Tea Party phenomenon as a jumping-off point to examine a number of ideological tropes and rhetorical devices in American politics. It argues that the political language of the Tea Party is not – as is often assumed – empty moralizing at the expense of intellectual depth, but rather draws on a wide variety of American political and intellectual themes and traditions. The article uses the campaign literature and polemic of key Tea (...) Party affiliates – Sarah Palin, Christine O’Donnell, Glenn Beck, Ron Paul – as entry points to discuss the movement’s political strategies and interpretation of the role of government, individual liberty, American exceptionalism, constitutionalism, the free market, and the common people. In placing these discussions in their historical and intellectual context, the article argues for taking the Tea Party’s political message seriously, not least as a reflection of prevalent democratic concerns and frustrations with the American political system in its current incarnation. Cheyne and Girard characterize felt presence during sleep paralysis attacks as a pre-hallucinatory expression of a threat-activated vigilance system. While their results may be consistent with this interpretation, they are nonetheless correlational and do not address a parsimonious alternative explanation. This alternative stipulates that FP is a purely spatial, hallucinatory form of a common cognitive phenomenon—social imagery—that is often, but not necessarily, linked with threat and fear and that may induce distress among susceptible individuals. The occurrence of both fearful and (...) non-fearful FPs in a multiplicity of situations other than sleep paralysis attacks supports the notion that FPs are hallucinatory variants of social imagery and that they are not necessarily bound to threat-activated vigilance. Evidence linking FPs with anxiety disorders supports the notion that the distress they evoke may be mediated by a more general affective distress personality factor. To illustrate the predominantly spatial character of FP hallucinations, similarities between FP and phantom limbs are summarized and the possibility that these two phenomena are parallel expressions of a mirror neuron system is considered. The following article presents preliminary reflections on a processual theory of health and disease. It does this by steering the discussion more toward an ontology of organisms rather than conceptual analysis of the semantic content of the terms “health” and “disease.” In the first section, four meta-theoretical assumptions of the traditional debate are identified and alternative approaches to the problems are presented. Afterwards, the view that health and disease are constituted by a dynamic relation between demands imposed on an organism (...) and individual presuppositions for adequate response is developed. In the last section, the paper takes stock of three possible objections to and clarifies some implications of this approach to the notions of health and disease. (shrink)

Deceased organ donation is widely considered as a case of easy rescue―that is, a case in which A may bestow considerable benefits on B while incurring negligent costs herself. Yet, the policy implications of this observation remain unclear. Drawing on Christopher H. Wellman’s samaritan account of political obligations, the paper develops a case for a so-called opt-out system, i.e., a scheme in which people are defaulted into being donors. In this chapter, I argue that one can articulate a historically attuned and analytically rich model for understanding jazz in its various inflections. That is, on the one hand, such a model permits us to affirm jazz as a historically conditioned, dynamic hybridity. On the other hand, to acknowledge jazz’s open and multiple character in no way negates our ability to identify discernible features of various styles and aesthetic traditions. Additionally, my model affirms the sociopolitical, legal (Jim Crow and copyright (...) laws), and economic structures that shaped jazz. Consequently, my articulation of bebop as an inflection of Afromodernism highlights the sociopolitical, and highly racialized context in which this music was created. Without a recognition of the sociopolitical import of bebop, one’s understanding of the music is impoverished, as one fails to grasp the strategic uses to which the music and discourses about the music were put. At the heart of any theoretical problem of justice lies the problem of motivation: Even if we could conceive of a way to develop a comprehensive system of just laws, and even if we could rationally believe in the justice of these laws, how could we ever ensure that we—or anyone else—would be motivated to abide by them? By unearthing how the problem of motivation sways canonical discussions of justice, the article brings forth intrinsic similarities and differences in these discussions (...) that are often overlooked in the literature. In particular, the article highlights intrinsic similarities in the analysis of the concept of justice in two central works that belong to the continental and the analytic tradition respectively and are otherwise rarely discussed together: Hegel’s Outlines of the Philosophy of Right and Rawls’s Theory of Justice. Over the course of the twentieth century, nationalistic approaches to the obstacles of racism in the United States have increasingly come to be seen as the more revolutionary of the various forms of anti-racist struggle. This paper explores several historical instances of Black Nationalism and seeks to demonstrate that, despite the many points on which they might diverge, they share in common a tendency to naturalize and embrace the category of race as a basis for political struggle, and that they (...) therefore constitute an ideologically accommodating and hence essentially regressive approach to the questions of race and racism. It is suggested that a critique of the modern category of race and a political practice aimed at its denaturalization will be a necessary aspect of any attempt to overcome racial oppression and inequality. The past decade has seen an explosion of work on the history of the human sciences during the Cold War. This work, however, does not engage with one of the leading human sciences of the period: linguistics. This article begins to rectify this knowledge gap by investigating the influence of linguistics and its concept of study, language, on American public, political and intellectual life during the postwar and early Cold War years. I show that language emerged in three frameworks in (...) this period: language as tool, language as weapon, and language as knowledge. As America stepped onto the international stage, language and linguistics were at the forefront: the military poured millions of dollars into machine translation, American diplomats were required to master scores of foreign languages, and schoolchildren were exposed to language-learning on a scale never before seen in the United States. Together, I argue, language and linguistics formed a critical part of the rise of American leadership in the new world order — one that provided communities as dispersed as the military, the diplomatic corps, scientists and language teachers with a powerful way of tackling the problems they faced. To date, linguistics has not been integrated into the broader framework of Cold War human sciences. In this article, I aim to bring both language, as concept, and linguistics, as discipline, into this framework. In doing so, I pave the way for future work on the history of linguistics as a human science. (shrink)

Philosophy and science employ abstract hypothetical scenarios- thought experiments - to illustrate, defend, and dispute theoretical claims. Since thought experiments furnish no new empirical observations, the method prompts two epistemological questions: whether anything may be learnt from the merely hypothetical, and, if so, how. Various sceptical arguments against the use of thought experiments in philosophy are discussed and criticized. The thesis that thought experiments in science provide a priori knowledge through non-sensory grasping of abstract entities is discussed and rejected. The (...) thesis that thought experimentation consists in manipulations of mental models is examined and found to be of limited epistemological relevance. It is argued that thought experiments are associated with characteristic arguments in a manner similar to ordinary experiments. It is further argued that thought experiments function in the same way as experiments in general: by providing premises for their associated arguments. Like other experiments, a thought experiment is successful when the premises it provides are true. This holds both for philosophical and scientific thought experiments. An argument schema is proposed and shown to be a formal analogue to that associated with ordinary experiments; similar in being subject to epistemological holism; but differing in being modal: in employing statements about possibility and necessity. The evaluation of thought experiments thus depends on how modal statements may be justified. Intuition and conceivability are discussed as sources of modal justification and found problematic. Instead it is suggested that evaluation proceed by accommodation of the statements describing the experiment's hypothetical scenario. The method of accommodation is developed and applied to five influential thought experiments in philosophy: the brain in a vat; Putnam's Twin Earth; Burge's arthritis example; Searle's Chinese Room; and Newcomb's problem. Its application shows some of these to be failed, others to be successful only relative to controversial philosophical doctrines. (shrink)

In this article I argue for the continuity of Sartre's theory of alienation. Therefore, I will depict how the concept of 'alienation' is further developed by Sartre since his early writings, by discussing the different forms of alienation in his late oeuvre and in his works on moral philosophy. First, I will take up the differenciation of individual and social alienation and, furthermore, I will discuss Sartre's radicalized form of alienation, which is beyond pure forms of exploitation or recurrence and (...) was not discussed in the literature, yet. I will connect Sartres theory of value in his "L'Être et le Néant" with the theory of alienation in his "Cahiers pour une Moral" and the "Critique de la Raison dialectique". (shrink)

Public reason liberalism strives to accommodate as broad an array of viewpoints as possible. Some people are selective science skeptics, meaning that they disagree with parts of mainstream science. Of special interest for this paper are climate deniers, who disagree with the mainstream consensus views of climate science. This creates a problem for public reason: on the one hand, public reason wants to avoid basing rules and policies on controversial principles, values, and so on. On the other hand, there are (...) citizens whom we cannot outright call irrational who are skeptical about central tenets of climate science. This seems to imply that public reason cannot base policies on the robust findings of climate science because these findings are controversial among the citizenry. But we have strong reasons to base our policies vis-à-vis climate change on the robust findings of climate science. How should we proceed? (shrink)

The emerging epistemic community of ecosemioticians and the multidisciplinary field of inquiry known as ecosemiotics offer a radical and relevant approach to so-called global environmental crisis. There are no environmental fixes within the dominant code, since that code overdetermines the future, thereby perpetuating ecologically untenable cultural forms. The possibility of a sustainability transition (the attempt to overcome destitution and avoid ecocatastrophe) becomes real when mediated by and through ecosemiotics. In short, reflexive awareness of humankind's linguisticality is a necessary condition for (...) transforming ecologically maladaptive cultural forms. As a multidisciplinary, interdisciplinary research program integrating the human and natural sciences, ecosemiotic inquiry closes the gap between biophysical ecology and human ecology. A provisional outline of a pragmatic theory of ecoserniotics attempts to describe the processes by which adaptive cultural changes might be facilitated and points toward substantive content areas that constitute sites for further research. Ecosemiotic inquiry frames cultural codes as these shape and reproduce the ongoing stream of individual and societal choices that shape distinctively human existence in a larger context of biophysical realities that drive natural selection. However, while ecosemiotics is a necessary condition for the sustainability transition, it is not a sufficient condition. (shrink)

In the luck egalitarian literature, one influential formulation of luck egalitarianism does not specify whether equalities that do not reflect people’s equivalent exercises of responsibility are bad with regard to inequality. This equivocation gives rise to two competing versions of luck egalitarianism: asymmetrical and symmetrical luck egalitarianism. According to the former, while inequalities due to luck are unjust, equalities due to luck are not necessarily so. The latter view, by contrast, affirms the undesirability of equalities as well as inequalities insofar (...) as they are due to luck. The symmetrical view, we argue, is by far the more compelling, both by internal luck egalitarian standards and in light of the external rightist emphasis on choice and responsibility to which luck egalitarianism may partly be seen as a response. Our main case for the symmetrical view is that when some people, against a background of equal opportunities, do not exercise their responsibility to the same degree as others, they cannot justifiably call for equalizing measures to be put in place. Indeed, such measures would be positively unfair. The symmetrical view, accordingly, rejects compensation in such cases, whereas the asymmetrical view, implausibly, enjoins it. We also examine two objections to this argument. First, that this view fails to qualify as genuinely egalitarian, instead collapsing the notion of equality into the notion of desert. Second, that the opposing asymmetrical view, in contrast to the symmetrical view, can draw support from its compatibility with sufficientarian concerns. Both objections are rebutted. We conclude that luck egalitarians are best served by endorsing the symmetrical, luck-neutralizing stance. (shrink)

Sharon Street vertritt einen Humeanischen Konstruktivismus in der Metaethik, nach dem die normativen Gründe einer Akteurin von dem System ihrer eigenen normativen Urteile abhängen. Ein normatives Urteil ist nach Street genau dann wahr, wenn es zu der ideal kohärenten Menge der normativen Urteile gehört, die die Akteurin im Überlegungsgleichgewicht hätte. In diesem Aufsatz wird die Frage diskutiert, wie diese Konzeption von Normativität mit einer Konzeption von Moral verbunden werden kann. Eine Möglichkeit hierfür besteht darin, an einer engen Verbindung von Normativität (...) und Moral festzuhalten. In diesem Fall muss die Wahrheit moralischer Sätze jedoch auf eine ähnliche Art als akteursrelativ verstanden werden, wie Street die Wahrheit normativer Sätze versteht. Eine zweite Möglichkeit besteht darin, an einem absolutistischen Verständnis moralischer Sätze festzuhalten. Dann wären nach Streets Konzeption von Normativität jedoch Fälle denkbar, in denen eine Akteurin keinen normativen Grund hat, moralisch zu handeln. Beide theoretische Optionen scheinen kontraintuitive Implikationen zu haben, die z.B. mit der Möglichkeit moralischen Tadels oder der Vorstellung der Kategorizität moralischer Sätze zusammenhängen. Aufbauend auf Überlegungen von Street, Bernard Williams und David Lewis wird jedoch dafür argumentiert, dass insbesondere die zweite der genannten Optionen nicht so sehr von einem herkömmlichen Moralverständnis abweicht, wie es zunächst erscheint. ABSTRACT I argue that people have a right to self‐determination when they are plainly predominant in a certain territory and do not violate the civil liberties of minorities. But there is no self‐determination without the preservation of self‐identity and the cultural preservation that goes with its secure existence. So to preserve autonomy and self‐determination people must preserve their cultural identity and this cannot be securely sustained in modern conditions without a nation‐state concerned to nourish that identity. Such considerations support a (...) right to secession when certain conditions are met. The conditions are that the people in question have a cultural identity, live in a distinct territory which they have inhabited for a long time, form an extensive majority, and respect the civil liberties of the minorities living in that territory (as well as elsewhere). Where they are such a group they have a right to secede from a larger state to which they are historically attached. These conditions, I argue, are met in Quebec. (shrink)

Intellectual engineering movements in early 20th century America – including scientific management, the progressive engineering platform, and technocracy – have received a great deal of attention from historians. Contemporaneous with these American movements, a British engineer was also developing a system of social and economic reform: the engineer was Major Clifford Hugh Douglas and the reforms would form the foundations of the Social Credit philosophy. While Social Credit has been studied extensively as a political and economic system, little consideration has (...) been given to the influence of Douglas’ engineering career on his ideology or to the relationship between Douglas and the American engineering reformists. This paper remedies this lacuna by analyzing Douglas’ proposed reforms in an engineering context. It is argued that the set of reforms proposed by Douglas in the final years of the First World War was an engineer’s view of the economic re-organization necessary for the betterment of the lower classes, the alleviation of scarcity, and the loosening of the noose which the existing financial system held around the neck of productive industry. Developed contemporaneously with, but ideologically independent from, the American intellectual engineering movements, Douglas’ reforms represent a technical response to the ills of World War I British society. It is concluded that Douglas’ engineering training and experience was central to his reform platform. (shrink)

Summary The recovery of the Camp Century deep ice core in 1966 – the first ice core to reach all the way through a polar ice sheet to bedrock – marked a shift from an era of United States military dominated glaciological research in Greenland to an era of climate oriented research on the island. This paper aims to provide an understanding of this shift. I show that the Camp Century ice core was at the heart of a complex blend (...) of environmental, military and scientific interests. By deconstructing these interests, I ultimately show that the island of Greenland underwent two reimaginings during the early Cold War. First, the island was reimagined as part of the US Cold War military sphere: driven by the need to secure the North American continent, the US established a hegemonic military colonization of Greenland. In the second reimagining of the island, environmental geography led the way: the scientific results of the Camp Century ice core and political concern about climatic change converged in the early 1970s to build Greenland into a unique location for pursuing research on climate questions. This paper adds to the literature by contextualizing the Camp Century ice core at the interface between the history of science, environmental history and Cold War history, and thereby illuminating Greenland as a dual geopolitical entity and environmental space. By highlighting the interaction of climatic change, geophysical sciences and national security narratives, it responds to recent historiographic calls to unite a set of narratives which, too often, talk past one another. In all great moral issues the moralist must choose and choosing has a price.

The vital status of patients who are a part of controlled donation after circulatory death (cDCD) is widely debated in bioethical literature. Opponents to currently applied cDCD protocols argue that they violate the dead donor rule, while proponents of the protocols advocate compatibility. In this article, we argue that both parties often misinterpret the moral implications of the dead donor rule. The rule as such does not require an assessment of a donor’s vital status, we contend, but rather an assessment (...) of whether procurement of organs in cDCD cause the death of the donor or not. We then argue that commonly practiced cDCD protocols do not violate the dead donor rule, since the donation does not trigger or cause the death of the donors. (shrink)

As we write this, philosophers all over the world are in a state of temporary, collective self-scrutiny. Tey are poring over the results of the PhilPapers Survey, conducted by David Chalmers and David Bourgeta grand-scale survey of the professions views on 30 major philosophical issues, ranging from aesthetic value to zombies. More than 3000 people have responded, andmanymore are currently absorbing and analyzing the results.

Metaphilosophy is itself philosophy about philosophy. It is not something before or independent of philosophy. Both Kai Nielsen and Richard Rorty are deeply concerned (someone might say obsessively preoccupied) with metaphilosophy. They both are thoroughly historicist and contextualist resolutely rejecting any form of a transcendental or metaphysical turn. They argue against claims to absolute validity (as well as against absolutism in any form) and a natural order of reasons: some 'Reason' to which any rational agent must be committed. They (...) both see philosophy as a transitional genre first (historically speaking) from religion then metaphysics and more latterly from scientistic conceptions of the world. But they differ about what philosophy is transitional to. For Rorty it is historical narrative and utopian proposals; for Nielsen it is critical theory. Rorty claims this, Nielsen's intentions to the contrary notwithstanding, commits him to enlightenment rationalism. Nielsen replies that his form of critical theory is deeply historicist and contextual without being resolutely atheoretical. This plays out in political orientation to Nielsen's being a socialist while Rorty is a social democrat. (shrink)

Resumen: Este trabajo propone una aproximación a tres obras centrales de la poesía latinoamericana: Trilce, Altazor y En la masmédula, tomando como base la confrontación entre las limitaciones que el lenguaje necesariamente impone y la voluntad radicalmente transgresora que estos textos exhiben. En particular, el trabajo explora la tensión entre la tendencia del lenguaje a fragmentar la realidad mediante conceptos y la aspiración a la unidad -la superación de toda fragmentación- que denotan los procesos verbales desplegados en estas obras. Para (...) profundizar el análisis, se propone un diálogo entre el lenguaje poético y el pictórico, tomando como referencia los planteamientos teóricos de Piet Mondrian y su visión acerca de la relación entre lo “individual” y lo “universal”.: This article presents an approach to three masterpieces of Latin American poetry: Trilce, Altazor, and En la masmédula, based on the confrontation between the limitations that language necessarily entails and the rule-breaking attitude that these poetical works display. The article examines the role of natural kinds in semantic theorizing, which has largely been conducted in isolation from relevant work in science, metaphysics, and philosophy of science. We argue that the Kripke–Putnam account of natural kind terms, despite recent claims to the contrary, depends on a certain metaphysics of natural kinds; that the metaphysics usually assumed—micro-essentialism—is untenable even in a ‘placeholder’ version; and that the currently popular homeostatic property cluster theory of natural kinds is correct only to an extent (...) that fails to vindicate the Kripke–Putnam account.
